1. Acceptance of Terms

By accessing or using Alaska Healthcare Hub (“AKHCH,” accessible at akhch.org), any user (“User,” “you”) agrees to be bound by these Terms of Use (“Terms”). If agreement with these Terms is not given, access to or use of this website must cease immediately. AKHCH reserves the right to modify these Terms at any time. Continued use of the website following any modification constitutes acceptance of the revised Terms.

2. Description of Service

AKHCH is an independent, privately maintained community platform that provides a directory of healthcare-related organizations, a collaboration board, event listings, resource pages, and informational content related to healthcare in Alaska. AKHCH is not a governmental entity and is not operated by, affiliated with, or endorsed by the State of Alaska, any federal agency, or any tribal organization.

3. User Accounts and Registration

Certain features of the website require registration. By creating an account, the User represents that all information provided is accurate, current, and complete. The User is responsible for maintaining the confidentiality of login credentials and for all activity that occurs under the User’s account. AKHCH must be notified immediately of any unauthorized use of the account.

AKHCH reserves the right to suspend or terminate any account at any time, with or without notice, for any reason, including but not limited to violation of these Terms.

4. User-Submitted Content

Users may submit content to AKHCH, including but not limited to directory listings, collaboration postings, event listings, comments, and messages (“User Content”). By submitting User Content, the User represents and warrants that:

(a) The User owns or has the right to submit all content provided;
(b) The content is accurate and not misleading;
(c) The content does not violate any applicable law, regulation, or third-party right;
(d) The content does not contain malicious code, spam, or fraudulent information.

By submitting User Content, the User grants AKHCH a non-exclusive, royalty-free, worldwide license to use, display, reproduce, and distribute the content in connection with the operation of the website. AKHCH reserves the right to remove, edit, or refuse any User Content at its sole discretion.

5. Accuracy of Information

AKHCH does not independently verify the accuracy, completeness, or currency of any information on this website, whether created by site administrators or submitted by Users. All information is provided “as is.” Users are solely responsible for independently verifying any information before making decisions or taking actions based on it. 6. Prohibited Conduct

Users agree not to:

(a) Submit false, misleading, or fraudulent information to the directory, collaboration board, or any other feature;
(b) Impersonate any person or entity, or misrepresent affiliation with any person or entity;
(c) Use the website to solicit, harass, or harm other Users;
(d) Attempt to gain unauthorized access to any part of the website, other User accounts, or connected systems;
(e) Use automated tools (bots, scrapers, crawlers) to access or extract data from the website without prior written permission;
(f) Use the website for any unlawful purpose or in violation of any applicable local, state, federal, or tribal law;
(g) Interfere with or disrupt the website’s infrastructure, security features, or other Users’ ability to use the platform.

7. Intellectual Property

The design, layout, code, and original content of AKHCH are the property of the site creator(s) and are protected by applicable copyright and intellectual property laws. Users may not reproduce, distribute, or create derivative works from the website’s design or original content without prior written permission.

9. Privacy

AKHCH collects certain information in connection with account registration, directory submissions, and website usage. User-submitted information (organization name, contact details, service descriptions) is publicly visible on the website by design. Account email addresses are used for platform communications and are not shared with third parties for marketing purposes. Users who wish to remove their publicly visible information may delete their listing or contact the site administrator.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, AKHCH AND ITS CREATOR(S), CONTRIBUTORS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO THE USE OF THIS WEBSITE, INCLUDING BUT NOT LIMITED TO: LOSS OF DATA, LOSS OF REVENUE, FAILED PARTNERSHIPS, REGULATORY PENALTIES, AUDIT FINDINGS, OR ANY OTHER ADVERSE OUTCOME.

THE TOTAL AGGREGATE LIABILITY OF AKHCH FOR ANY CLAIM ARISING FROM USE OF THIS WEBSITE SHALL NOT EXCEED ONE HUNDRED DOLLARS ($100.00 USD).

11. Indemnification

The User agrees to indemnify, defend, and hold harmless AKHCH, its creator(s), contributors, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising from or related to: (a) the User’s use of the website; (b) any User Content submitted by the User; (c) the User’s violation of these Terms; or (d) the User’s violation of any applicable law or third-party right.

12. Dispute Resolution

Any dispute arising from or related to these Terms or the use of this website shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, the dispute shall be resolved through binding arbitration administered under the rules of the American Arbitration Association, with the arbitration taking place in Anchorage, Alaska. Each party shall bear its own costs. The arbitrator’s decision shall be final and binding.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Alaska, without regard to its conflict of law provisions.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining provisions of these Terms remain in full force and effect.
